TrekO Seller Agreement

This Seller Agreement ("Agreement") governs the use of TrekO.ai by any individual or business that lists products or services for sale on the Platform. By creating listings or completing sales through TrekO.ai, you agree to comply with this Agreement, the Terms of Service, Privacy Policy, and all other applicable TrekO policies.

By selecting "I Agree" during seller registration or by listing an item for sale on TrekO.ai, you acknowledge that you have read, understood, and agree to be legally bound by this Seller Agreement.

1. Seller Eligibility

To sell on TrekO.ai you must:

• Be at least eighteen (18) years old.
• Provide accurate account and verification information.
• Have the legal right to sell every item you list.
• Comply with all applicable local, state, federal, and international laws.

2. Seller Responsibilities

Sellers are responsible for the accuracy of every listing, including:

• Titles
• Descriptions
• Photos
• Pricing
• Condition
• Shipping weight and dimensions
• Category selection
• Any required disclosures

Listings must accurately represent the item being offered. Knowingly misleading buyers may result in listing removal, account suspension, or permanent termination.

3. Marketplace Syndication and Third-Party Marketplaces

TrekO.ai allows sellers to publish eligible listings to supported third-party marketplaces and commerce platforms, including but not limited to Amazon, eBay, Etsy, Shopify, Meta/Facebook Marketplace, and other approved services.

By choosing to publish a listing through TrekO.ai to a third-party marketplace, you authorize TrekO.ai to transmit and synchronize listing information, images, pricing, inventory, shipping details, and other information reasonably necessary to create, maintain, or update your listings on those platforms.

Listings published to third-party marketplaces remain subject to the terms, policies, fees, and seller requirements of those marketplaces. TrekO.ai does not control and is not responsible for listing approvals, account restrictions, suspensions, removals, policy enforcement, or other actions taken by third-party marketplaces.

Where supported by the applicable marketplace integration, TrekO.ai may synchronize inventory levels, pricing, order status, tracking information, and other listing data between TrekO.ai and participating marketplaces.

4. Prohibited Listings

Sellers may not list products that violate TrekO policies or applicable law, including but not limited to:

• Counterfeit merchandise
• Stolen property
• Illegal drugs or controlled substances
• Fraudulent digital assets
• Items that infringe copyrights or trademarks
• Restricted weapons or prohibited products
• Malicious software or deceptive digital downloads

5. Marketplace Fees

TrekO may charge marketplace fees, payment processing fees, shipping label fees, promotional fees, or other disclosed charges. Applicable fees will be displayed before a listing or transaction is completed.

Fees may change over time. Continued use of the Platform constitutes acceptance of any updated fee schedule.

6. Payments and Seller Payouts

TrekO processes payments using approved third-party payment providers and supported blockchain payment systems.

Seller payouts may be delayed for fraud prevention, identity verification, dispute resolution, payment processor requirements, or other legitimate business reasons.

TrekO may place temporary holds on payouts when reasonably necessary to protect buyers, sellers, or the Platform.

7. Marketplace Facilitator and Sales Tax

Where required by applicable law, TrekO operates as a marketplace facilitator and may calculate, collect, and remit applicable sales tax on eligible transactions completed through the Platform.

Sellers remain responsible for providing accurate business information, tax identification information when required, and complying with any tax obligations not collected by TrekO.

8. Shipping Responsibilities

Unless otherwise specified, sellers are responsible for:

• Packing sold items securely.
• Shipping within the stated handling time.
• Using the shipping service selected during checkout.
• Providing accurate shipment information.
• Complying with carrier requirements.

Repeated late shipments or excessive delivery issues may result in account review.

9. Digital Products and Blockchain Assets

Sellers offering digital works, NFTs, blockchain assets, publications, or downloadable products are responsible for ensuring they possess all necessary ownership and distribution rights.

Blockchain transactions may be irreversible and network fees are outside TrekO's control.

10. Intellectual Property

Sellers retain ownership of the content they upload but grant TrekO a worldwide, non-exclusive license to display, market, index, and promote listings while they remain active on the Platform.

Sellers represent that uploaded content does not infringe the rights of any third party.

11. Account Suspension

TrekO may suspend or permanently terminate seller accounts for:

• Fraudulent activity.
• Repeated policy violations.
• Chargeback abuse.
• Intellectual property violations.
• Unsafe or prohibited products.
• Providing false account information.

12. Changes to this Agreement

WEB3 TREK, INC. may modify this Agreement from time to time. The updated version becomes effective upon publication on TrekO.ai. Continued use of the Platform constitutes acceptance of the revised Agreement.
