These Terms and Conditions(“Terms”) govern your access to and use of TrekO.ai (the “Platform”), which is operated by WEB3 TREK, INC. (“we,” “us,” or “our”). By creating an account, accessing, or using TrekO.ai, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
You may use TrekO.ai only if you:
To use certain features (such as selling or purchasing items), you must create an account and provide accurate, current information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
You agree to notify us immediately at support@treko.ai of any unauthorized use of your account or other security concerns.
TrekO.ai provides tools for users to list, display, buy, and sell physical items, artwork, collections, digital works, blockchain assets, publications, and blockchain-backed collections. We are a platform provider only. Unless explicitly stated otherwise, we are not the buyer or seller in any transaction between users.
You agree to use the Platform only for lawful purposes and in accordance with these Terms and all applicable laws and regulations.
Sellers are responsible for the accuracy of their listings, including titles, descriptions, prices, photos, product condition, category selection, shipping information, and compliance with applicable laws. Buyers are responsible for reviewing item details before making a purchase and for providing accurate payment and shipping information.
Where required by applicable marketplace facilitator laws, TrekO.ai may calculate, collect, and remit applicable sales taxes on behalf of sellers. Sellers authorize TrekO.ai to perform these functions for transactions processed through the Platform. Sellers remain responsible for all other tax obligations, including income taxes, business taxes, and any taxes not collected or remitted by TrekO.ai.
We may charge marketplace fees, payment processing fees, shipping-related fees, tax-related service fees, or other service fees for certain transactions or Platform features. Any applicable fees will be disclosed before you complete a transaction.
By providing your mobile telephone number and expressly consenting to receive SMS/text messages from Web3 Trek AI Inc. or TrekO.ai, you agree that we may send you account notifications, order and delivery updates, customer support communications, promotional messages, marketplace updates, and other service-related messages.
Message frequency varies and messages are sent infrequently. Message and data rates may apply. Consent to receive SMS/text messages is not a condition of purchasing any goods or services.
You may opt out at any time by replying STOP to any message. For assistance, reply HELP or contact us at support@web3trek.ai.
Mobile phone numbers and SMS consent information will not be sold, rented, or shared with third parties or affiliates for their marketing or promotional purposes. Information may be shared with service providers solely as necessary to provide the messaging service.
TrekO.ai uses third-party payment processors, digital payment providers, cryptocurrency payment providers, tax calculation providers, shipping providers, and other third-party service providers to facilitate marketplace transactions. These providers may include, but are not limited to, Stripe, PayPal, blockchain wallet providers, cryptocurrency payment services, and other approved payment or financial service providers.
By making or receiving payments through TrekO.ai, you also agree to be bound by the applicable terms, user agreements, and privacy policies of any payment providers used to complete your transaction.
You authorize TrekO.ai and its approved payment service providers to:
TrekO.ai does not control and is not responsible for the performance, availability, security, or business decisions of third-party payment, cryptocurrency, tax, banking, or shipping service providers. The availability of payment methods may change without notice.
TrekO.ai operates as a marketplace facilitator where required by applicable marketplace facilitator laws. For eligible transactions, TrekO.ai may calculate, collect, and remit applicable sales, use, value-added (VAT), goods and services (GST), or similar transaction taxes on behalf of sellers using approved tax calculation and compliance services.
Sales tax and similar transaction taxes are determined based on applicable laws, the buyer's shipping destination, product taxability, marketplace facilitator requirements, and other jurisdiction-specific rules. Taxes displayed during checkout may vary depending on the transaction details and applicable law.
Sellers authorize TrekO.ai to collect and remit applicable marketplace taxes on their behalf where required or permitted by law. Sellers agree not to separately collect sales tax from buyers for transactions in which TrekO.ai collects and remits such taxes.
Sellers remain responsible for all other tax obligations, including income taxes, business taxes, self-employment taxes, and any sales, use, VAT, GST, or similar taxes not collected or remitted by TrekO.ai. TrekO.ai may update its tax collection and remittance practices as tax laws, regulations, or marketplace facilitator requirements change.
Sellers are responsible for shipping sold items to buyers using the shipping method selected at checkout (which may include rates provided through integrated services such as EasyPost or carriers like USPS or UPS).
Risk of loss passes from the seller to the buyer once the item is handed to the carrier, unless otherwise required by applicable law. TrekO.ai is not responsible for delays, damage, or loss caused by carriers or incorrect shipping information provided by users.
For digital works, blockchain assets, publications, and blockchain-backed collections, you acknowledge that:
You are solely responsible for understanding the risks associated with digital works, blockchain assets, publications, wallets, and blockchain transactions before participating in any related transaction.
You retain ownership of any content you upload to TrekO.ai, including images, artwork, descriptions, and listing information (“User Content”). By uploading User Content, you grant WEB3 TREK, INC. a non-exclusive, worldwide, royalty-free license to host, display, and use your User Content in connection with operating, promoting, and improving the Platform.
You represent and warrant that you have all necessary rights to upload and use the User Content and that your content does not infringe any third-party rights, including copyright, trademark, or privacy rights.

The Platform is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied. We do not warrant that the Platform will be uninterrupted, secure, or error-free, or that any defects will be corrected.
We make no guarantees regarding the quality, safety, legality, or fitness of any items listed by users, nor the conduct of buyers or sellers.
To the maximum extent permitted by law, WEB3 TREK, INC. and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly, arising out of or in connection with:

We may update these Terms from time to time. When we do, we will revise the “Last Updated” date at the top of this page. Your continued use of TrekO.ai after any changes become effective constitutes your acceptance of the revised Terms.
We may suspend or terminate your access to the Platform at any time, with or without notice, if we believe you have violated these Terms or engaged in behavior that may harm the Platform, other users, or third parties.
You may stop using the Platform and close your account at any time. Certain provisions of these Terms will continue to apply after termination, including those relating to payments, intellectual property, limitations of liability, and indemnification.
These Terms are governed by the laws of the State of Montana, USA, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or your use of TrekO.ai will be resolved in the courts or through arbitration venues located in Montana, unless applicable law requires otherwise.
